I’ve been following crypto legislation for years now. Nothing prepared me for this morning’s bombshell.

Understanding the Two Different Bills in Play

First, let’s clear up the confusion here.

There are actually two separate legislative efforts happening simultaneously. The Clarity Act is the House-originated bill everyone’s been discussing.　It’s formally called the Digital Assets Market Clarity Act. This bill has recently hit major delays and turbulence.

Even Brian Armstrong from Coinbase has been vocal about it. Now we have this second bill from the Senate. It’s the Digital Commodity Intermediaries Act from the Agriculture Committee.

Here’s something most people don’t understand about Washington. Different committees literally own different pieces of the crypto puzzle.

The Banking Committee handles SEC and securities-related matters. The Agriculture Committee owns CFTC and commodity regulations.

This new bill focuses purely on the commodity side. That means Bitcoin, exchanges, and spot markets fall here.

This part actually made me laugh out loud. The Senate just invented regulatory speedrun mode for crypto exchanges.

They’re calling it “expedited registration with provisional status.” I call it the legal version of wearing pajama pants on Zoom.

The CFTC gets 180 days to create this expedited process. That’s a hard deadline from when the bill passes. Then exchanges have 90 days to register or face consequences.

This is where I got genuinely angry reading the bill. The December draft had explicit self-custody protections written in. Clear, statutory language protecting your right to hold your own Bitcoin.

Hardware wallets, software wallets, peer-to-peer transactions — all protected. You could point to this law in court if needed.

Then I Opened the January 2026 Version

The self-custody language is completely gone. Deleted, Vanished, surgically removed without explanation.

No press release announcing the change. No floor speech justifying the deletion. Just clean removal like it never existed.

This matters more than you might think. Law isn’t poetry — if it’s not written, it’s not protected. Without that clause, self-custody lives in regulatory gray zones.

It becomes subject to agency interpretation and future political moods. The bill doesn’t ban self-custody outright. But it stops affirmatively protecting it. That’s a massive difference in legal terms.
