ミーガン法と性犯罪者
沖縄の少女レイプ事件長野豊さん、本件に興味をお持ちの皆さん、アメリカへの問い合わせメールはこんな感じです。これに資料が加わります。何か付け加えたい質問等あればコメントに書いといてください。(注)英文はこの訳文ほど変ではないので安心してください。◆ ◆ ◆分からない方もいらっしゃるでしょうから、ことの経緯を少々説明します。以前、長野豊さんからこんな質問をいただきました。 ミーガン法1995年に沖縄で起きた米兵による小学生強姦事件の犯人が、ミーガン法に基づいて性犯罪者として公開されてるか知りたいです。 http://www007.upp.so-net.ne.jp/togo/dic/sa/girlrape.html国外で性犯罪を起こして、その国で服役した場合もミーガン法が適用されてるのか分からないのでお願いします。この件は一般の掲示板やフォーラムで尋ねても分かるわけがないので、僕は専門の市民団体に問い合わせてみましょうと返答しておいたわけです。そういう経緯でこのメールが出てくるわけです。◆ ◆ ◆はじめまして。本日お便りしておりますのは、情報を求めてインターネットで検索中に次の一文を見つけたからです。「Laura Ahearnは、元ソーシャルワーカーで、現在、並々ならぬ決意を持って性犯罪者を見つけ出し、再犯を防ぐために活動している女性である。」本メールは、1995年に、沖縄で少女を誘拐、暴力を加え、無慈悲にも強姦した三人の元アメリカ兵について情報を求めるために差し上げております。CNN.comは1995年11月7日に次のようにレポートしています。「検察によると、Gill、Harp、Ledetは道路を歩いていた少女をレンタカーに無理やり連れ込んだ。HarpとLedetは少女の目と口をテープで塞ぎ、手足を縛り上げ、抵抗する少女の顔と腹を殴りつけた。そしてGillとHarpは人気のない海辺で少女を強姦した。Ledetは強姦しようとしたが成し遂げられなかった。」Rodrico Harp, Kendrick M. Ledet, and Marcus D. Gill の三名は、当局により逮捕され、裁判、有罪判決、そして7年の懲役を日本で言い渡されました。刑期を日本で済ませたのち、アメリカへと送り返され、軍からは除隊させられています。今現在、彼らの居場所はわからず、性犯罪者リストに登録されていないかも知れません。ミーガン法我々は日本のインターネット市民で、これらの獣たちは一生見張られているか、もしくは少なくとも性欲が小さくなるまでは監視されていなければならないと考えています。我々はアメリカ人が、彼らについて何も知らないのではないかととても心配しています。この三人は今現在、アメリカのどこかで暮らしており、誰かの隣人となっていることは間違いありません。彼らの犯した犯罪の国際性に鑑み、最も重要な論点は、(1)ミーガン法はこの三人のように、海外で性犯罪を犯し収監されたこのある人物をも、リストに載せるように強制していますか?(2)もしそうでなければ、彼等を性犯罪者リストに載せる方法はありますか?我々はできれば彼らの居場所が特定され、性犯罪者リストに記載されるべきと考えています。犯罪の地が、アメリカ国内であるか国外であるかはあまり関係ないでしょう。これら証明済みの獣たちは、監視されることなく街を堂々と歩きまわっています。なぜそんなリスクをとる必要がありますか?今の状況は、アメリカの子供やその親にとっても、極めて危険な状態であるかもしれません。どの子であっても日本の少女のように彼らに餌食にされてはなりません。Parents For Megan's Lawの方々も、我々と同じくらい本件に関心を持っていただけるとうれしいです。どのような手助けでも構いません。よろしくお願いします。追伸下のリンクから、この三名とその犯した犯罪、もっと正確の情報へとたどることができます。Dear Sir/Madam,I'm contacting "Parents For Megan's Law" because the following sentence turned up while surfing through the internet looking for help: "Laura Ahearn is a woman to be reckoned with; a social worker turned crusader, determined to identify and stop sexual predators."This e-mail is to solicit relevant information available with regard to three American individuals, former Marine and Navy servicemen, who kidnapped, brutalized and mercilessly raped a 12 year-old Japanese girl in Okinawa, Japan in September, 1995.CNN.com reproted in November 7, 1995, "According to prosecutors, Gill, Harp and Ledet snatched the girl off the street and forced her into a rented van. Harp and Ledet taped shut her eyes and mouth, bound her feet and hands and beat her face and stomach to keep her from struggling, prosecutors said. Authorities maintain that Gill and Harp then raped the girl at an isolated beach. Ledet tried and was unable, they said." Rodrico Harp, Kendrick M. Ledet, and Marcus D. Gill were later arrested, tried in court, convicted, and sentenced to 7 years of imprisonment by the Japanese authorities. They served in jail here in Japan. They were sent back to the U.S. upon completion of their term of imprisonment in 2003 and then were dismissed from the military. Their whereabouts in the U.S. are unknown. The likelihood is that they are not even listed on the registry as sex offenders.The Megan's LawWe are a group of concerned internet citizens in Japan who believe that those predators must be monitored as long as they live or, at least, while they are going through the period of time in which they are sexually most active. We are particularly concerned about the likelihood that Americans are neither informed nor aware of the fact that these men are sex offenders, child abusers. These predators surely live in someone's neighbor somewhere in the U.S.In light of the international nature of the crime they committed, the most important issues are:(1) Does the Megan's Law mandate to list those offenders who committed their crimes and jailed overseas like Rodrico Harp, Kendrick M. Ledet, and Marcus D. Gill?(2) If not listed yet, is there a way to put them on the registry as child abusers?We strongly believe that they must be located and listed on the registry because a rapist is a rapist regardless of the geographic location of the crime scene, committed either inside or outside of the borders of the United States. These proven predators must not walk unmonitored. Why take the risk? The situation could potentially be hazardous for American kids and parents. No little girl must be victimized like the poor little Japanese girl in Okinawa. I hope that people at "Parents For Megan's Law" become interested now in this issue as much as we are here in Japan.
