Several days ago, Japan was hit by huge typhoon.
Though the scale of damages are still not clear, it is certain that there are sufferers all over the Japan.
Kentaro Imada, a lawyer who is vice chairperson of the Japan Federation of Bar Association’s Disaster Recovery Assistance Committee and the chairperson on the same kind of committee in the Hiroshima Bar Association, released messages for all victims. These messages are written in plain, simple words full of his kindness and passion. I want to share these messages with all sufferers who are now in agony.
As I live in the United States, I cannnot support victims directly. So I decided to translate these messages into English. I can easily imagine how hard and sad it is to be unable to get necessary information.
I would like to provide this useful information for minorities who are suffering from this tremendous disaster in a foreign country, Japan.

For all sufferers of the Recent Typhoon,
Ten Important Pieces of Advice from a Lawyer
I would like to express my deep sympathy for those who are suffering from this typhoon.
I’m a chairperson of the Committee on Disaster Recovery Assistance in the Hiroshima Bar Association.
I have supported the victims of large-scaled natural disasters that have happened here in Hiroshima. I would like to send the below 10 pieces of advice based on these previous experiences for all victims who are now in agony and sadness.
1. Don’t make too much effort to remove dirt!
As the dirt that flowed to your houses may contain something toxic for your health, you should not make too much effort to remove it. It will make you exhausted and enhance the risk of the death related to disasters. What is most important is to keep and recover your health. You should wait for help from the local government or volunteers.
2. Don’t worry about lost things!
The titles you have will never disappear even though you lose some kinds of certificates. Please don’t worry even though you lost precious belongings, such as bank books or a certificate of title.
3. Take photos of your houses!
I highly recommend that you take photos of your damaged houses from various angles. It will be surely useful to get an appropriate disaster damage certificate. The content of the certificate influences the amount of public support you can get. If you have some complaints about the certificate, you can request to that the degree of damage be estimated again.

4. Don’t hurry to fix your house!
You have to wait until your house is dry before fixing it.
You should consider whether the entire fixing plan and costs are really necessary. If you use some kinds of public support (upper limit is only 584,000 yen, based on “temporary repairs” in the Disaster Relief Law) without deep consideration, that may prevent you from applying for public temporary housing even if your house is not fixed yet.
5. Take a consultation before you pay!
There are various kinds of public supports to aid you as for removing dirt or fixing your house. You should be careful before you decide to pay private companies for these expenses because you might not get public support once you pay a private company.
I highly recommend that you take a free consultation in the city hall. Checking the city websites that have various information is also effective for you.
6. Confirm the content of your insurance!
Recently, most homeowners’ insurance policies cover flood damage. You can also use homeowners’ insurance and car insurance. First, you should confirm the holder’s name of insurance. You can receive insurance payments even if you lost the certificate of insurance.
When you are not sure about the name of insurance companies or the contents of the insurance policies, you can call the below general insurance association of Japan.

7. How to deal with a third party’s belongings.
When you cannot judge whether you can discard a third party’s belongings that flowed to your property, you should ask at city hall or through the free telephone consultation provided by a local bar association.
Even though you may know the owner’s name of something that flowed to your house, asking experts for help is safer to keep a good relationship with your neighbors.

8. For those who lost their incomes
If you find it difficult to earn living because of the loss of your workplace or a sudden, temporary work stoppage, you can use various kinds of public support such as employment insurance, business loan, group subsidies, etc. that aim to encourage recovery in the area. As there are systems to support employers, please confirm what information is useful for you by asking for city hall or free telephone consultation.
You can also consult lawyers how to reschedule your repayment plan.
9. Reduction and Exemption from taxes
There are various kinds of public support when large-scale disasters happen, such as reductions and exemptions of some kinds of taxes, special provisions for utility costs, subsidies for education fees. As there might be some areas where administration of the public support still doesn’t function, you should wait for the setting up of the consultation system.

10. You can surely recover your life again!
I can imagine you don’t know what to do from here after losing your house or belongings. The victims of torrential rains in Western Japan in 2018 experienced the same feelings.
However it’s possible for you to recover your life through using the various systems that can strongly support you, such as subsidies for recovery, donations, insurance, loans, and the system to remove multiple loans. There is also a special loan for elders to fix or reconstruct their homes.
I know it’s difficult for you to understand these unexpected, difficult things. That’s why we lawyers are here. As most consultations are free, you may use the consultation system, even if you think it is only a small or trivial matter.
These are the pieces of advice from me, a lawyer who has heard from many sufferers’ voices in two torrential rain disasters in 2014 and 2018.
I avoided using academic and legal terms in order to make my message easier to understand. Please share this advice with those now in agony.
日本に巨大台風が上陸、甚大な被害が出ています。
被害の全貌はまだ明らかになっていませんが、日本全国に被災された方々がいらっしゃることは確実な状況です。
この度、日本弁護士連合会災害復興支援委員会副委員長かつ広島県弁護士会災害対策委員会委員長の今田健太郎弁護士が、被災者の方々に向けて、平易な言葉でありつつも非常に重要なメッセージを公表されました。今田さんのこれまでの被災者支援のご経験、情熱、優しさに満ちた素晴らしい内容ですので、一人でも多くの方々に読んで頂きたいと思います。
アメリカにいる私は、直接のお手伝いはできないので、何かできることはないだろうかと考え、この貴重なメッセージを英訳して公表させて頂くことにしました。
アメリカでマイノリティとして暮らしている私にとって、困っているときに必要な情報が入らないということが、どんなに辛く危機的な状況か容易に想像がつきます。
現在日本で、外国人として、また、被災者として、二重の意味でのマイノリティに陥っている方々に、少しでもお役に立てればと思いました。

【水害直後 弁護士からの10か条】〜西日本豪雨の教訓を踏まえて
★ 全国の被災者の方々へお見舞い申し上げます。
広島弁護士会の災害対策委員長を務めています。
二度の大規模水害を支援してきた弁護士として、知らないことで悔し涙を流された、多くの被災者の方々を代弁する、切なる願いです。
1 土砂撤去で無理をしないで。
〜 自宅も気になりますが、土砂は細菌も含んでおり、想像以上に健康状態を悪化させ、災害関連死のリスクを高めます。
自力では限界があるので、まずは体力の回復に努めてください。行政やボランティアからの案内を待ちましょう。
2 通帳や権利証を紛失しても大丈夫。
〜 銀行の預金通帳や、定期預金証書、不動産の権利証などを紛失しても、財産はなくなりませんので、安心して下さい。
3 落ち着いたら、自宅の写真撮影を。
〜 自宅の写真を、複数の角度から撮影し、被害に見合った罹災証明書の発行を受けられるようにしましょう。
判定の結果は、公的支援の内容に影響します。
不服があれば再調査の申入れが可能です。

4 修理は決して急がず。
〜 自宅の修理は、乾燥してから行う必要があります。また、災害救助法の応急修理の制度（例 /半壊以上で58万4000円までの費用補助）を使うと、原則、仮設住宅へ入居できません。慌てないで、全体の修理内容や費用面をしっかり検討してからにしましょう。一部だけの修理で、壊れたままの家に住むことを余儀なくされる可能性があります。

5 お金を払う前に、行政の窓口で相談を。
〜 土砂の撤去や、自宅の修理につき、公的支援の制度があります。事前に役所へ相談しないで業者などに支払った場合、後から請求できないことがあるので、要注意です。必ず行政窓口で相談してください。
もっとも、被災直後は、自治体も対応できないケースがありますので、体制が整うまで、待ちましょう。
各自治体ごとにホームページを開設していますので、情報を確認してみて下さい。
6 保険の内容を確認しよう。
〜 近時の住宅保険には、火災保険に水災の補償が付いているものが多いです。また、家財保険による補填も考えられます。自分名義でなく、親族が契約している場合もあるので、よく確認してみましょう。
証券を紛失しても請求できます。
自動車保険も同様です。
保険会社が分からなくなったときや、契約内容を確認したい場合には、損保協会の照会センター

7 敷地内の物の処分や撤去について。
自宅に流れ着いた第三者の物や、廃棄物の処分について悩んだ場合、まずは、行政窓口や、各地の弁護士会が近々開設する被災者電話相談などを利用して、処分してよいかどうか、費用はどうするか等、相談してみてください。
また、隣家の家財やブロックなど、所有者が分かっていて撤去を求めたい場合も、すぐには解決できないこともありますので、ケンカせず、弁護士会などを頼ってください。

8 収入の目処が立たない方々へ。
〜 水害で職場が水没した。道路が寸断されて、勤務先へ行けない。明日からの収入の目処が立たない方々に対しては、雇用保険の失業給付等、色々な制度があります。
また、雇い主側を補助する制度もありますので、少し落ち着いたら、各自治体や弁護士会の電話相談などにお問い合わせ下さい。
事業者（個人も）向けの融資や、地域を再生するためのグループ補助金などもあります。
弁護士による相談の場合、各種ローンの返済などのお困りごとにも対応します。
9 税金の減免や、教育の補助など。
〜 大規模災害時には、各種税金等の免除や、水道光熱費の特例、教育費用の補助など、実に様々な支援が用意されています。
行政も、まだ機能していない地域もあるかもしれませんが、慌てることなく、相談体制が整うのを待ちましょう。

10 必ずや生活再建は出来ます！
〜 愛着のある家を失って、途方に暮れている方々が大多数だと思います。
西日本豪雨災害も同様でした。
しかし、今後、公的制度による給付金（生活再建支援金等）や、義援金、保険金、各種の融資制度、二重ローン減免制度など、色々な仕組みを活用することで、生活再建を図ることは可能です！
高齢者の方々に向けての、修理や再築のための特例融資制度もあります。
『難しいことはよく分からない』
分からなくて当然です。
ぜひ、弁護士などの専門家を頼ってください。
